Privacy Policy Liability

Why you need a well written Privacy Policy:

  • The Federal Trade Commission fined makers of the “Path” mobile application $800,000 for collecting personal information that was not disclosed in their privacy policy.

  • W3 Innovations was fined $50,000 by the FTC for not complying with COPPA and collecting information from children under the age of 13 in its mobile app iPhone games.

  • Google paid a $22.5 million civil penalty for not properly disclosing in its Privacy Policy how it tracks cookies.

A privacy policy is a statement notifying visitors to your website and customers of your service what kind of personal information will be collected from them and how it will be used. Companies can expose themselves to government fines and regulatory liability if they don’t include certain disclosures in their privacy policy. The requirements are constantly evolving and I keep up to date with all privacy statutes, regulations, and requirements to make sure that your privacy policy is always in compliance.

Your company could also expose itself to liability in class action lawsuits for potentially millions of dollars if you handle your customer’s personal information differently from how you disclose you will handle it in your privacy policy. Accordingly, it is very important that every privacy policy be unique and specifically tailored to each individual business and how it handles its customers’ personal information. It’s also important that a privacy attorney discusses the policy with your IT department to make sure that the privacy policy is accurate and that they know how to comply with it.

A terms of use is a contract that users of your website or product agree to in order to use your site or product. I have drafted dozens of privacy policies and terms of use for websites, products, and services of every industry. I have advised numerous companies on how to comply with statutory regulations and their own privacy policies.
